Examples
Worked examples
- Is an instance
A general-purpose AI model provider that crosses the systemic-risk compute threshold under Article 51 is investigated for compliance with Article 55's evaluation, incident-reporting, and cybersecurity duties by the AI Office directly, rather than by any individual Member State's national authority.
Counter-examples
Looks similar, but isn't
- Not an instance
A national market surveillance authority, not the AI Office, is the primary enforcement body for a high-risk AI system's Article 6/Annex III obligations at the deployer level (e.g. a hospital's diagnostic-support tool) -- the AI Office's direct enforcement role is specifically GPAI-model-focused; Member States handle most other AI Act enforcement.
Editorial commentary
The European AI Office sits within the European Commission’s Directorate-General for Communication Networks, Content and Technology (DG CONNECT), created by Commission Decision of 24 January 2024 and formally in force from 21 February 2024 — ahead of the EU AI Act’s own staged applicability dates, so the Office existed before most of the Act’s substantive obligations took effect.
Functions under the AI Act
- General-purpose AI (GPAI) enforcement: exclusive Union-level authority to investigate, request corrective action, and issue fines for GPAI provider non-compliance with Article 53 and the systemic-risk duties in Articles 51/55.
- Codes of practice and evaluation tools: developing, with GPAI providers and independent experts, methodologies and benchmarks for evaluating model capability and systemic risk.
- Coordination: supporting coherent application of the Act across Member States’ national market surveillance authorities, which retain primary enforcement over most high-risk-system obligations at the deployer level.
- Guidance and templates: publishing standard templates, including the one referenced in Article 27’s Fundamental Rights Impact Assessment requirement, and supporting the Article 4 AI literacy obligation with guidance and best-practice resources.
For how these obligations land on a research organization specifically, see CASRAI’s guide to EU AI Act obligations and exemptions for research organizations.
Frequently Asked Questions
Does the AI Office enforce the AI Act against every organization directly?
No — its direct enforcement authority is specifically over general-purpose AI model providers. Most other AI Act obligations (high-risk system deployment, Article 5 prohibited-practice compliance) are enforced by national market surveillance authorities in each Member State.
Is the AI Office a separate EU agency?
No. It is established within the European Commission itself, not as an independent EU agency.
