In the pharmaceutical industry, regulatory affairs (RA) is the function that owns a company’s relationship with drug and biologic regulators across the entire life of a product — from the first pre-IND meeting through the marketing application, the approval decision, and every change made to the product after it reaches the market. It sits organizationally inside the sponsor company, not the government: RA staff draft and file the submissions, run the strategy for what to ask a regulator and when, and carry ongoing accountability for keeping the product’s regulatory record current for as long as it stays on the market.

Before a marketing application is anywhere close to ready, RA is already setting strategy: interpreting applicable guidance, deciding which regulatory pathway fits the product (standard approval, Priority Review, accelerated approval, breakthrough designation), and managing the formal meeting process with FDA’s drug and biologic review divisions (CDER/CBER). FDA groups these meetings into defined categories under its PDUFA meeting-management framework: Type A meetings resolve an otherwise-stalled program (clinical holds, dispute resolution) and are targeted within 30 calendar days of request; Type B meetings occur at defined development milestones — pre-IND, End-of-Phase 2, pre-NDA/BLA — generally once per phase, targeted within 60 days; Type C covers any other topic outside those milestones, targeted within 75 days; and two categories added under PDUFA VII, Type D (a narrow 1–2 topic meeting needing input from a limited number of FDA disciplines) and INTERACT (early-stage advice for novel products facing issues with no existing guidance), round out the framework. RA typically owns the meeting request, the briefing book, and the agency correspondence that follows.

Building and Submitting the Marketing Application

When clinical development is far enough along, RA assembles the marketing application: a New Drug Application (NDA) for a drug product under the FD&C Act, or a Biologics License Application (BLA) for a biological product, defined at 21 CFR 601.2 as a request for permission to introduce a biologic into interstate commerce. Both are built to the ICH Common Technical Document (CTD) structure — a harmonized five-module dossier (administrative, CTD summaries, quality, nonclinical, clinical) used across NDA, BLA, and EU MAA submissions — and filed electronically per the eCTD specification. RA does not generate the underlying nonclinical or clinical data; it compiles, formats, and files it, and owns the narrative that ties the dossier together into a coherent regulatory argument.

The Approval Decision

After submission, FDA generally has 60 days to make a filing decision, then runs its substantive review. The outcome is either approval, or a Complete Response Letter (CRL) — issued only after a completed review cycle under 21 CFR 314.110, with grounds for non-approval specified at 21 CFR 314.125 (NDA) and 314.127 (ANDA). A CRL is distinct from a refuse-to-file letter, which happens pre-review over an incomplete application, and from an approval that carries post-marketing requirements, where the product is approved but FDA has attached conditions. RA owns the response strategy to a CRL — deciding what data or argument closes each deficiency and running the resubmission.

Post-Approval: Labeling, Change Control, and Lifecycle Maintenance

Approval does not end RA’s involvement — it shifts the work from getting the product approved to keeping the approved product’s regulatory record accurate as the product itself, its manufacturing, and its safety profile evolve. Every post-approval change to an NDA falls into one of three reporting tiers under 21 CFR 314.70 (a parallel structure applies to BLAs under 601.12): a Prior Approval Supplement (PAS) for changes with substantial potential to affect identity, strength, quality, purity, or potency — most formulation and manufacturing-process changes, and most labeling changes — which require FDA approval before the changed product can be distributed; a Changes Being Effected (CBE) supplement for moderate-risk changes, where a standard CBE-30 allows distribution 30 days after FDA receives it unless FDA objects, and a narrower CBE-0 covers specific categories such as safety labeling enhancements and permits distribution immediately upon receipt; and an Annual Report change for minimal-risk items such as certain editorial labeling edits or identical-equipment swaps, which need no pre-distribution approval at all. RA classifies every proposed change into the correct tier, prepares the supplement, and tracks the product’s full labeling history. On the safety side, RA also owns or co-owns the periodic aggregate safety reporting cadence — the Periodic Benefit-Risk Evaluation Report (PBRER) defined in ICH E2C(R2) for the post-approval period, distinct from the pre-approval Development Safety Update Report (DSUR) under ICH E2F.

  • Regulatory strategy. Choosing and sequencing the pathway to approval, including which designations to pursue and when to request a formal agency meeting.
  • Submissions management. Compiling, formatting, and filing INDs, marketing applications, and every post-approval supplement, in the correct CTD/eCTD structure.
  • Agency liaison. Owning the working relationship with reviewers — meeting requests, briefing documents, information requests, and CRL responses.
  • Labeling. Drafting and negotiating prescribing information and patient labeling, and managing every subsequent labeling change through its correct reporting tier.
  • Change control. Classifying manufacturing, formulation, and process changes into PAS/CBE/Annual Report tiers and filing the resulting supplement.
  • International submissions. Adapting the core CTD dossier for other regulatory regions (EMA, and other ICH and non-ICH authorities), where format is harmonized but requirements and timelines are not identical.
  • Cross-functional review. Reviewing promotional material, clinical protocols, and manufacturing change proposals for regulatory risk before they go external or get implemented.

How the Role Differs Before vs. After Approval

Pre-approval, RA work is strategy-heavy and episodic: a small number of high-stakes agency meetings and one large marketing-application submission, built around getting a novel product across a single approval decision. Post-approval, the work becomes higher-volume and continuous: a steady stream of manufacturing, labeling, and safety-driven supplements, each individually smaller than the original application but collectively constant, plus periodic safety reporting and monitoring for competitor and guidance changes that could affect the product’s labeling or claims. Professionals sometimes specialize in one side or the other — a development/submissions-focused RA role versus a labeling and lifecycle-management role — though many mid-career RA professionals move between both.

Regulatory Affairs vs. Adjacent Functions

The name “regulatory affairs” gets applied to several distinct roles, and mixing them up leads to miscalibrated expectations, especially for someone new to the field or moving in from adjacent research administration.

  • Regulatory affairs (pharma industry, this page) — the sponsor-side execution function: determines pathway, files submissions, owns agency correspondence, manages labeling and post-approval change, for a company’s own product pipeline.
  • Regulatory intelligence — the input layer that monitors the external regulatory environment (new guidance, competitor approvals, policy shifts) and turns it into a documented input to RA’s strategy. It does not file anything itself.

The typical ladder runs from Regulatory Affairs Associate/Specialist, through Senior Specialist and Manager (usually where product- or therapeutic-area ownership begins), to Associate Director/Director (strategy across a portfolio) and VP-level roles (regulatory policy and organizational strategy). The Regulatory Affairs Certification (RAC), administered by the Regulatory Affairs Professionals Society (RAPS), is the field’s primary standalone credential — offered in separate Drugs and Devices designations — and is knowledge-based rather than a practice license, since no formal license exists for this profession.
